This privacy policy applies to our online shop inoxmetall.ch and to our domains that redirect to this shop (e.g. gartendusche.ch). It is based on the Swiss Federal Act on Data Protection (FADP). Where the EU General Data Protection Regulation (GDPR) applies in individual cases, the rights provided for therein apply in addition.
2. What data we process and when
2.1 Visiting the website. When you access our pages, technically necessary data is recorded: IP address, date and time, pages accessed, browser, operating system and referrer. We need this data for secure operation, error analysis and anonymous visitor statistics.
2.2 Cookies. Our shop uses cookies and similar technologies from Shopify. They are required for the shopping cart, checkout, customer account and security, and they provide aggregated statistics. In addition, we use analytics and advertising cookies from Google and Meta (see sections 4.2 and 4.3), but only if you consent in the cookie banner. You can change your selection at any time using the «Cookie settings» link in the footer. You can delete or block cookies in your browser at any time; some shop functions may then no longer be available.
2.3 Contacting us. If you contact us via the contact form, by email, telephone or WhatsApp, we process your details (e.g. name, email, telephone, postcode/town, product and your message) in order to answer your enquiry and prepare a quotation.
2.4 Orders and customer account. For an order, we process your name, billing and delivery address, email, telephone, the products ordered and payment details. We use this data for processing the contract, delivery, installation, invoicing and warranty. If you open a customer account, we also store your order history.
2.5 Newsletter and reminders. You will only receive the newsletter with your consent. When you sign up, for example in the discount window or when completing an order, we use your email address and, if provided, your name to send you information about our products, new arrivals and offers about once a month and for promotions. You confirm your subscription via a link in an email (double opt in). If you have consented to marketing, you may also receive a reminder about an incomplete shopping cart. To improve the newsletter, we analyse whether and when you open our emails and which links you click. We use Klaviyo to send it (see section 3.7). Every email contains an unsubscribe link. You can withdraw your consent at any time, via this link or by sending an email to info@inoxmetall.ch.
2.6 Configurators, PDF and enquiries. In our configurators and calculators (garden showers, privacy screens, SlideGlass, raised beds), your configuration is calculated directly in your browser, as is the PDF with 3D views. Only when you send an enquiry do we transmit your details (name, email, telephone, postcode/town, message, configuration, PDF and any photos or plans you attach) via the automation service Make (Celonis, data centre in the EU) to our Microsoft 365 mailbox. On request, you will receive a confirmation with the PDF by email.
2.7 Your photo and live view (AR). If you upload your own photo or use the live view with your camera, the image is processed only in your browser and is not transmitted to us, unless you expressly attach it to an enquiry.
2.8 Solar check. To calculate the yield of the solar privacy screen, we transmit the location you have selected (address or coordinates) to the geoservices of the Federal Office of Topography swisstopo (address search, aerial image, elevation model) and to PVGIS, the solar calculator of the Joint Research Centre of the European Commission. No names or contact details are transmitted.
2.9 Anonymous usage statistics for the configurators. To help us improve our configurators, we record anonymously which equipment is configured, the price displayed, whether a PDF was created, an enquiry was sent or a product was added to the cart, the duration of use and the device type (computer, tablet or mobile phone). We do not store your name, email, IP address or any other information that could identify you. The statistics are stored with Make (Celonis, data centre in the EU).
3. Service providers and disclosure
We do not sell your data. We only pass it on to service providers that we need to operate our shop and company, and only to the extent necessary:
3.1 Shopify. Our shop runs on the Shopify platform (Shopify International Limited, Dublin, Ireland, with group companies in Canada and the USA). Shopify stores the shop, order and customer data on our behalf. More information: Shopify privacy policy.
3.2 Payment. Payment is processed via Shopify Payments. Depending on the payment method chosen, the necessary payment data is transmitted to the respective provider: credit cards (Visa, Mastercard, American Express, UnionPay), Apple Pay, Google Pay, Shop Pay, TWINT or Klarna. For purchases on account or instalment payments via Klarna, Klarna may carry out a credit check. We do not see your card details.
3.3 Shipping and installation. For delivery, we pass on your name, delivery address and telephone number to the commissioned transport company and, for installation, to our installation team.
3.4 Email and communication. We use Microsoft 365 for email and calendar. If you write to us via WhatsApp, the terms of WhatsApp (Meta) also apply.
3.5 Accounting and quotations. We manage quotations, invoices and accounting with bexio (bexio AG, Switzerland).
3.6 Make. We use the automation service Make (Celonis, data centre in the EU) to transmit enquiries from our configurators and for the anonymous usage statistics.
3.7 Klaviyo. We use the service Klaviyo (Klaviyo, Inc., 125 Summer Street, Boston, MA 02110, USA) to send the newsletter and the welcome email. On our behalf, Klaviyo stores your email address, your name, the time of your subscription and confirmation, and information on the opening of and clicks in our emails. Klaviyo also receives information from our shop about your orders so that we can send you suitable content. Klaviyo participates in the Swiss-U.S. Data Privacy Framework and the EU-U.S. Data Privacy Framework. We have a data processing agreement with Klaviyo that also provides for standard contractual clauses. More information: Klaviyo privacy policy.
3.8 Shopify Network Intelligence. Shopify uses data from our shop in a secured form, aggregated with other Shopify data, to improve its own services, product recommendations and advertising. Other merchants cannot view this data.
3.9 Authorities. If we are legally obliged to do so, we pass on data to authorities.
4. Google services and links to third parties
4.1 Google Maps. On the contact page you can display a map from Google Maps (Google Ireland Limited, Ireland; Google LLC, USA). The map is only loaded when you click «Show map». Only then is data such as your IP address transmitted to Google.
4.2 Google Ads and Google Analytics. We advertise with Google Ads and measure the success of our ads and our website with Google Analytics (Google Ireland Limited, Ireland; Google LLC, USA). Cookies are set and data such as your IP address (shortened), device, pages visited, clicks on ads and completed orders are transmitted to Google. This shows us which ads lead to enquiries or purchases and allows us to show suitable ads to visitors of our website later (remarketing). These services are only activated with your consent via the cookie banner. You can also switch off personalised advertising from Google at adssettings.google.com.
4.3 Advertising on Facebook and Instagram (Meta Pixel). We place ads on Facebook and Instagram and use the Meta Pixel and the Conversions API for this purpose (Meta Platforms Ireland Limited, Ireland; Meta Platforms Inc., USA). Data such as your IP address, device, pages visited and completed orders are transmitted to Meta. This allows us to measure which ads are effective and to show suitable ads on Facebook and Instagram to visitors of our website and to similar audiences. If you are logged in to Meta, Meta may associate this data with your account. The Meta Pixel is only activated with your consent via the cookie banner. You can adjust your advertising settings in your Facebook or Instagram account under «Ad preferences».
4.4 Links. Our pages contain links to Google reviews, Instagram, Facebook, YouTube, WhatsApp and Google Maps. These services only become active when you click the link. From then on, the privacy policy of the respective provider applies.
5. Transfer abroad, retention and security
5.1 Abroad. Some service providers process data outside Switzerland, in particular in the EU, Canada and the USA (Shopify, Microsoft, Google, Klarna, Meta, Make, Klaviyo). Under Swiss law, the EU and Canada are considered countries with adequate data protection. For transfers to the USA, we rely on the Swiss-U.S. Data Privacy Framework where the recipient is certified, or on the standard contractual clauses recognised by the Federal Data Protection and Information Commissioner (FDPIC).
5.2 Retention. We only retain personal data for as long as is necessary for the respective purpose. We retain order and invoice data for ten years due to the statutory retention obligation (Art. 958f of the Swiss Code of Obligations). We delete enquiries that do not result in an order as soon as they are no longer needed. After you unsubscribe from the newsletter, we only retain your email address and the time you unsubscribed, so that you do not receive any further emails and we can demonstrate your withdrawal.
5.3 Security. We protect your data with appropriate technical and organisational measures. The connection to our shop is encrypted (HTTPS).
6. Your rights
Under the FADP, you have in particular the right:
- to obtain information about which data we process about you
- to have incorrect data corrected
- to request the deletion of your data, unless there is a retention obligation
- to object to processing and to withdraw consent at any time
- to receive your data in a common format (data portability)
An email to info@inoxmetall.ch or a letter to the address in section 1 is sufficient for your request. We may ask for proof of identity. You can also lodge a complaint with the Federal Data Protection and Information Commissioner (www.edoeb.admin.ch).
7. Changes
We may amend this privacy policy at any time. The version published on inoxmetall.ch applies.
